User Agreement

This User Agreement (hereinafter referred to as the "Agreement") regulates the terms of use of digital products and services provided by Silica Limited Liability Company (hereinafter referred to as the "Company", "Silica LLC", "we").

By using any Company services, the user confirms that they have read, understood and unconditionally accepted the terms of this Agreement.

1. Terms and definitions

User - any individual or legal entity using the Company's services.

Services - AI chatbots, analytical dashboards, websites, landings, software solutions, consulting and digital products.

AI - automated algorithms and artificial intelligence models.

2. Subject of the agreement

2.1. The Company provides the User with access to digital services on an "as is" (AS IS) basis.

2.2. The Company does not guarantee that the services will meet the User's expectations, their business goals or specific jurisdiction legislation requirements.

3. Terms of use

3.1. The User undertakes to use the services:

  • lawfully,
  • in good faith,
  • at their own risk.

    • 3.2. It is prohibited to:

  • use services for unlawful purposes;
  • transmit knowingly false data;
  • attempt to interfere with the Company's systems.

    • 4. Artificial intelligence and analytics

    4.1. The Company's services may use AI for:

  • automatic responses,
  • data analysis,
  • generating texts, reports and visualizations.

    • 4.2. The User acknowledges and agrees that:

  • AI may make mistakes;
  • AI results are not the ultimate truth;
  • analytics and forecasts are informational in nature.

    • 4.3. AI responses ARE NOT:

  • financial recommendations;
  • investment advice;
  • legal conclusions;
  • management decisions.

    • 5. Limitation of liability

    5.1. Silica LLC IS NOT LIABLE for:

  • any decisions of the User made on the basis of data, AI responses or dashboards;
  • direct and indirect losses;
  • loss of profit, customers, data or reputation;
  • errors of AI, algorithms or third-party services;
  • business downtime, technical failures, data inaccuracies.

    • 5.2. The User accepts that all responsibility for using the services lies solely with them.

    5.3. The Company's maximum liability, if recognized by the court, is limited to the amount actually paid by the User (if applicable).

    6. Websites and web development

    6.1. The Company is not liable for:

  • further use of the website by the User;
  • content posted by the User;
  • consequences of SEO, advertising, conversions and sales.

    • 6.2. All business results of the website depend on:

  • niche,
  • marketing,
  • actions of the User,

    • and not on the Company.

    7. Service availability and operation

    7.1. The Company has the right to:

  • change service functionality;
  • suspend operation for updates;
  • disable services without prior notice.

    • 7.2. The Company does not guarantee uninterrupted operation of services.

    8. Intellectual property

    8.1. All rights to software code, architecture, design, algorithms and AI logic belong to Silica LLC.

    8.2. The User does not have the right to:

  • copy,
  • distribute,
  • modify services without written consent of the Company.

    • 9. Personal data

    9.1. Processing of personal data is carried out in accordance with the Silica LLC Privacy Policy.

    9.2. By using the services, the User gives consent to data processing.

    10. Access termination

    10.1. The Company has the right to restrict or terminate the User's access to services without explanation, if:

  • the terms of the Agreement are violated;
  • there are legal risks;
  • there are suspicions of abuse.

11. Agreement changes

11.1. The Company has the right to unilaterally change this Agreement.

11.2. The new version comes into force from the moment of publication.

12. Applicable law

12.1. This Agreement is governed by the legislation of the Kyrgyz Republic.

12.2. All disputes are subject to consideration in the courts of the Kyrgyz Republic.
